Dutch Online Gambling Regulations Possibly Delayed image

The continued written consultation took place with the Minister for Legal Protection Sander Dekker and the standing committee for Justice and Security, on June 18th. During the meeting, the minister made a statement about the expected opening date of the online gambling market in the Netherlands with the Remote Gambling Act, as well as the cooling-off period of penalized casinos.

 

The Remote Gambling Act possibly postponed for a few months 

 

Several motions were suggested during the consultation, such as motion 82, where MP van Nispen stated that preparations for the online gambling market had suffered some delays, partly as a result of the COVID-19 measures. 

In response to this, Minister Dekker said that the target date for opening the Dutch Gambling market is January 2021. However, since the outbreak of the new Coronavirus, land-based casinos have been complaining about guests switching to illegal gambling providers, and that could have been prevented with the Remote Gambling Act. 

Contrarily, concerns about meeting license obligations in time arose among interested parties. However, because of The Ministry of Justice and Security’s busy agenda, the Minister said he does not exclude that this will lead to a slight delay. In further clarification, Dekker described the delay “about a few months”.
 

Cooling-off period for penalized operators extended


Currently, penalized operators face a two-year cooling-off period. Motion 83 requests the government to extend the cooling-off period by a proportional period if the market opening is postponed. Minister Dekker said he will let the cooling-off period move with an effective date. 

If the Remote Gambling Act will face a delay, but the current cooling-off period of 2 years is maintained, that would mean that many more penalized operators are ready at the start of the online gambling market. In order to avoid this, the motion will be forwarded to the House of Representatives, which will have to approve the motion in a vote.
